Credit termination decision

The intensive care department of a leading Dutch bank is considering to withdraw its credit facilities to a well-known family-owned business. One of the reasons is a loss of trust in management. The are no turn around signs. At least, according to the bank. The restructuring bankers do want to make a careful decision as thousands of employees face the risk of losing their jobs and the bank’s image is at stake. An objective, independent view is necessary.

  • How has the relationship between the bankers and company management evolved?
  • Is it justifiable to withdraw the credit facilities given the current situation?
  • Is there a risk that the bank will be prosecuted for wrong conduct if the company bankrupts following the credit termination?
